Kenya High Court: Bia Tosha cannot halt Diageo-Asahi transaction
Kenya | The High Court, on 2 June, dismissed with costs an application by Bia Tosha Distributors seeking to stop the proposed Diageo-Asahi transaction. In its ruling, the Court noted that Bia Tosha is already pursuing the same issues at the Court of Appeal. The Court reiterated its previous ruling dated 9 April that Bia Tosha lacked a legal nexus to the share transfer and failed to establish a prima facie case to halt the transaction.
